Property Pre-Mediation - Getting the preparation right for our clients biggest financial decision

Presenter: Joanne Law

The quality of property mediation often depends on the work completed before the parties enter the mediation room. Effective pre-mediation preparation helps clients understand the process, identify the information they need, obtain appropriate advice, and make informed decisions about their financial future.

This practical session explores how mediators can prepare clients for one of the biggest financial decisions of their lives while promoting informed participation, safety, and procedural fairness.

You will learn how to:

  • Screen and prepare clients within the Family Law Act section 79 property framework.
  • Build full and frank financial disclosure into your process from the very first client contact.
  • Help clients understand their circumstances and recognise when legal, financial or other professional advice is needed.
  • Identify red flags and vulnerabilities that may require a modified process or indicate that mediation may not be appropriate.

Whether you are new to property mediation or looking to refine your pre-mediation practice, this session will provide practical tools and strategies to help clients arrive at mediation informed, prepared, and ready to engage constructively.
