Property Mediation — How has the process changed since the FLA was amended?

The 2024 amendments to the Family Law Act brought the biggest shift to property settlement in decades. Family violence is now an express consideration in the property pathway; the four-step process has been codified; and there are new obligations regarding disclosure and the treatment of debts and wastage. If your property mediation practice hasn't been reviewed since these changes commenced, it's time.

In this session, Joanne Law, Director of Mediation Institute, walks through what the changes mean in practice for property mediators, including:

  • The codified property framework — what's now in the Act that used to live in case law
  • Family violence as an economic factor — how it now sits in the property pathway
  • Updated disclosure obligations and what mediators need to be aware of
  • Debts, wastage and add-backs under the new framework
  • Implications for intake, screening and process design in property matters
  • Practical adjustments to the way we run property mediations

We'll also look at how these changes affect assessment, suitability and the structure of property sessions.
