The Family Law Act and Children with Special Needs

Children with additional needs present unique considerations in family law matters, requiring careful legal, procedural, and practical responses. This session explores how the Family Law Act applies to cases involving children with special needs, including the types of needs that commonly arise in family law disputes and how the Courts approach these matters.

Participants will gain insight into relevant legislative provisions, case management considerations, and the role of expert evidence in parenting matters. The session will also examine how court orders can be structured to appropriately support children with special needs, and review selected cases and key considerations when matters proceed to mediation.
