Get Your Paperwork Right: Documentation That Protects You and Your Clients

Presenter: Joanne Law

Every mediation runs on paperwork — your information sheet, your Agreement to Mediate, your file notes. When done well, these documents set clear expectations and protect your clients and you. Done poorly, they're the first thing scrutinised when a complaint is made.

In this practical 60-minute webinar, Joanne Law walks through the documents that carry a mediation from first contact to closure and shows you how to get each one right. We'll cover the essential clauses of an Agreement to Mediate (and the gaps that catch people out), how to explain confidentiality and its limits in plain English, and how to keep genuinely defensible file notes.

You'll take part in a "good clause vs risky clause" exercise using real, de-identified examples, and leave with a checksheet to audit your own documents straight away.

Relevant to mediators across every practice area — workplace, commercial, community and family dispute resolution. FDR practitioners will find specific notes on their obligations under the Family Law Act and the Family Law (Family Dispute Resolution Practitioners) Regulations 2025.
